יב כִּי מַה לִּי לִשְׁפֹּט אֶת אֵלֶּה אֲשֶׁר בַּחוּץ? הַאִם אֵינְכֶם שׁוֹפְטִים אֶת אֵלֶּה שֶׁבְּקִרְבְּכֶם? יג אֵלֶּה אֲשֶׁר בַּחוּץ אֱלֹהִים יִשְׁפְּטֵם. אַתֶּם בַּעֲרוּ אֶת הָרַע מִקִּרְבְּכֶם.

ז כִּי־יִמָּצֵ֣א אִ֗ישׁ גֹּנֵ֨ב נֶ֤פֶשׁ מֵאֶחָיו֙ מִבְּנֵ֣י יִשְׂרָאֵ֔ל וְהִתְעַמֶּר־בּ֖וֹ וּמְכָר֑וֹ וּמֵת֙ הַגַּנָּ֣ב הַה֔וּא וּבִֽעַרְתָּ֥ הָרָ֖ע מִקִּרְבֶּֽךָ׃

12 For what have I to do to judge them also that are without? do not ye judge them that are within? 13 But them that are without God judgeth. Therefore put away from among yourselves that wicked person. (KJV)
Devarim / Deuteronomy 17:7
7 The hands of the witnesses shall be first upon him to put him to death, and afterward the hands of all the people. So thou shalt put the evil away from among you. (KJV)
Devarim / Deuteronomy 19:19
19 Then shall ye do unto him, as he had thought to have done unto his brother: so shalt thou put the evil away from among you. (KJV)
Devarim / Deuteronomy 22:21
21 Then they shall bring out the damsel to the door of her father’s house, and the men of her city shall stone her with stones that she die: because she hath wrought folly in Israel, to play the whore in her father’s house: so shalt thou put evil away from among you. (KJV)
Devarim / Deuteronomy 24:7
7 If a man be found stealing any of his brethren of the children of Israel, and maketh merchandise of him, or selleth him; then that thief shall die; and thou shalt put evil away from among you. (KJV)
Here Paul quotes from the Torah as a proof for what he is saying here in 1 Corinthians 5:12-13. All of the concepts Paul is stating here including judging those within the family of God and putting away the one who is evil is derived from Devarim / Deuteronomy 17:7, 19:19, 22:21, 24:7. The Torah has not passed away.
